Terms of Service

These Terms of Service ("Terms") govern your use of CommissionBoard, operated by Perk Panther LLC ("we", "us", "our"). By creating an account or using the Service, you agree to these Terms.

1. Service Description

CommissionBoard is a cloud-based commission tracking software that allows businesses to calculate employee commissions, display leaderboards, and generate reports. The Service is provided on a subscription basis.

2. Accounts

• You must provide accurate and complete information when creating an account.
• You are responsible for maintaining the security of your account credentials.
• You are responsible for all activity that occurs under your account.
• One subscription covers one business. Each additional location requires a separate location add-on ($20/mo per location).

3. Subscription & Billing

• The Service is billed monthly at $20/month per location.
• Payment is processed securely through Stripe.
• Subscriptions renew automatically each month until canceled.
• You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period.
• We do not offer refunds for partial months.
• If payment fails, your account may be marked as past due. Continued failure may result in suspension.

4. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to gain unauthorized access to other accounts or our systems
• Interfere with or disrupt the Service
• Upload malicious code or content
• Resell or redistribute the Service without permission
• Use the Service to store sensitive personal data beyond what is necessary for commission tracking (e.g., Social Security numbers, medical records)

5. Your Data

You retain ownership of all data you input into the Service. We do not claim any intellectual property rights over your business data. You grant us a limited license to store, process, and display your data solely for the purpose of providing the Service.

We implement industry-standard security measures including encryption in transit and at rest, row-level security policies, and regular security reviews. However, no system is 100% secure and we cannot guarantee absolute security.

6. Data on Cancellation

If you cancel your subscription, your data is retained so you may resubscribe in the future. If you wish to have your data permanently deleted, contact us at info@perkpanther.com. We will delete your data within 30 days of the request.

7. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable for maintenance, updates, or circumstances beyond our control. We are not liable for any downtime or data loss.

8. Limitation of Liability

To the maximum extent permitted by law, CommissionBoard and Perk Panther LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of the Service.

Our total liability for any claim related to the Service shall not exceed the amount you paid us in the 12 months prior to the claim.

9. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not warrant that the Service will be error-free, that commission calculations will be accurate in all cases, or that the Service will meet your specific requirements. You are responsible for verifying commission calculations before processing payroll.

10. Modifications to the Service

We reserve the right to modify, suspend, or discontinue any part of the Service at any time. We will make reasonable efforts to notify you of significant changes. Continued use of the Service after changes constitutes acceptance of the updated Terms.

11. Termination

We may suspend or terminate your account if you violate these Terms. You may terminate your account at any time by canceling your subscription and requesting account deletion.

12. Governing Law

These Terms are governed by the laws of the State of Michigan, United States, without regard to conflict of law provisions.

13. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page. Continued use of the Service constitutes acceptance.
